The Law on The Books: No Openly Gay Soldier can be Discharged
The 9th U.S. Circuit Court of Appeals in San Francisco said the "don't ask, don't tell" policy must be lifted now that the Obama administration has concluded it's unconstitutional to treat gay Americans differently under the law.
What this means to every service member around the world is that is now legal to openly serve and no soldier is allowed under the law to be discharged for being so.
There will be no appeals by the government to this since the Obama Administration already certified that discharging soldiers for being openly gay is contrary to equal human rights.

The ruling came in response to a motion brought by Log Cabin Republicans, a group for gay GOP members, which last year persuaded a lower court judge to declare the ban unconstitutional.
This ruling came about after the government appealed U.S. District Judge Virginia Phillips' decision, the 9th Circuit agreed to keep the policy in place until it could consider the matter. The appeals court reversed itself with Wednesday's order by lifting its hold on Phillips' decision.
The government will now have to hurry the implementation of allowing and not discharging openly gay personnel.
We have a long ways to go, but with this gay friendly administration doors have opened for us. When the President and the White House are not opposing by being critical or otherwise disruptive of gay equal rights in the country and the world, it makes things easier to happen. It open doors. Just like the UN adding Gay rights to Human rights around the world. The Gay Marriage vote in New York and so on.
We can remember how disruptive the Bush Administration was. Bush even proposed an amendment to the US constitution to only allow a one man one woman to be married.
The next big fight is DOMA= Defense of Marriage Act. Once this goes, married gay and lesbians would be able to access federal tax laws and benefits that straight couples enjoy.
We have to be grateful to this new generation of americans that don't care if their two male or two female neighbors marry or not. They don't buy that gays marrying will impact their own marriages. They don't buy that gay marriage would negatively affect any couple. That is how many irresponsible religious and government leaders have said, that gay marriage will destroy marriage.
These lies are to be sold to the bias and the ignorant. Both kinds can be hold at bay by information and knowledge. Thanks to the flow of information it is harder to keep lies secret. They can be exposed to the light and destroy.
