Man 290# Suing White Castle He is Too Fat To Fit in Seat, Could Not ask for Chair

A 290 pound man sues White Castle for unspecified damages relating to the Disabilities Act. Martin Kessman said he cannot fit into the booths at the fast food chain’s restaurants. When he made a complaint about the undersize seating, he was told that a change would be made, and the company went so far as showing him a blueprint of the new seating.

“They’re stationary booths,” Kessman told The New York Post. “I’m not humongous, but I’m a big guy. I could not wedge myself in.” The 290 pound man said he hit his knee on the metal post underneath the table when he tried to sit down.

A total of three complaints were filed by the Kessman, and each time he was offered a free hamburger. He said that the drawings for the new seating were shown to him two and a half years ago, but nothing has been done about it.

Kessman says that the failure to accommodate his needs violate the civil rights of overweight people. He says that the Americans with Disabilities Act is “applicable, not only to me, but to pregnant women and handicapped people.” Kessman says he has no problems sitting down at other fast food restaurants or onboard aircraft.

A White Castle representative said the man could have simply asked for a regular chair. Now thestockbroker is looking for unspecified damages and for White Castle to make a change to larger seating. His case was filed in a Manhattan federal court.
