Bisexual blogger who uses 'Speedo' name on gay websites faces lawsuit by Manuf





Swimsuit giant Speedo is taking legal action against a bisexual blogger for using its name in a number of gay porn sites.

The company lodged the trademark infringement lawsuit in Sydney, Australia, earlier this week against Dave Evans, who calls himself aussiespeedoguy.

On his website - which has dozens of photos of men in tight Speedo trunks - he states: ‘My name is Dave Evans - I'm a bisexual 24yo guy and this is my blog.

‘Right now I'm living on the NSW Central Coast (just north of Sydney) but I
enjoy travelling and I am lucky enough that my business allows me to travel.’
Among the links to pornographic sites on his blog include one for his own site, SpeedosNextDoor.com, and also one for ‘SwimmerBoys: For guys who loves Speedos’ , among numerous others.
Writing on Wednesday he confirmed he was being sued by Speedo, saying: ‘I've been told that AussieSpeedoGuy is a terrible infraction on the “Speedo” brand - and thus I am being sued.

‘My argument is that the term “speedo” is generic. Speedo Sex for example - most of my speedo sex stories involve AussieBum or ADIDAS clothing.  

 

‘I'm pretty sure “speedo” is now a culturally generic term.’
He then lists examples like Asprin, Dry Ice, Zipper, Band-Aid and Matchbox, before adding: ‘Today (September 21) I got an email telling me I'm due in court next Monday in the Federal Court of Australia.’

He says, however, he will not be attending as he doesn't own a tie and can't afford a lawyer.
Mr Evans has registered various domain names with Speedo in them - many showing pornographic images.
Lawyers for Speedo said the company wants to 'protect the substantial and valuable reputation and goodwill associated with the name and trademark Speedo' and is also seeking damages from Mr Evans.
The lawsuit seeks to have Evans' existing domain names containing the word Speedo handed over to the company.
