California prosecutors said on Thursday that a male porn actor and his pregnant lover concocted a phony alibi involving a friend from Mexico named 'Joe' in an effort to cover up the murder of a Texas millionaire.
A young Californian couple allegedly stabbed a wealthy man to death after they duped him into having a gay relationship and made him sign away his fortune.
David Enrique Meza, 25, and Taylor Marie Langston, 20, from San Diego, pleaded not guilty in a San Diego courtroom on Christmas Eve in the stabbing death of 52-year-old Jake Clyde Merendino, whom authorities said the couple killed after duping him into having a gay lover affair and then signing away his fortune.
'It’s about a love affair gone wrong,' Assistant US Attorney Alexandra Foster said during the indictment hearing, referring to Merendino and Meza's affair.
The rich Texas retiree's body was found with multiple knife wounds on May 2 beside a highway between Rosarito and Ensenada in Mexico, less than 20 miles from the US border.
According to prosecutors, Meza and Langston attempted to confuse investigators by coming up with a bogus alibi.
When interviewed by police about Merendino's death, Meza claimed he called him on the night of his death and the pair arranged to meet at the exact spot his body would later be found.
When Langston was interviewed, she said she crossed into Mexico on May 1 to visit Meza’s friend 'Joe'.
She said they sat at Joe's table for four hours, without eating, drinking or watching TV, and then returned home.
However 'Joe,' identified as Jose Aguilera by the FBI, said he hadn't seen the pair in a year and they had never been to his home in Tijuana.
He also told agents Meza had called him a week before he met with them, pleading with him to lie to police.
Days after Merendino's body was found, an attorney in Texas - who had drawn up the 52-year-old's will in 1998 - filed probate paperwork.
However, Meza, through his own attorneys, then contested it, allegedly producing a handwritten will that stated he was the only heir to Merendino's estate.
Said to have been written by Merendino on December 21, 2014, Meza was listed as the victim’s sole heir.
At the time of his death, Merendino was believed to be in a sexual relationship with Meza - who was living with his girlfriend Langston who was pregnant at the time of the slaying.
During a court appearance on Thursday, the pair pleaded not guilty to the plot. Meza was denied bond but Langston was given bail as she is nursing a baby.
Meza and Merendino met online in 2013 while the victim was living in Houston, and the two became romantically involved.
Merendino was left a large inheritance by his parents, but made some extra money by flipping houses. He used his money to travel around the world and also invested in art.
According to FBI documents, on April 29 the two men rented a car and drove to Mexico so Merendino could finalize a deal on a $300,000 property at Palacio del Mar, an upscale oceanfront development.
Some of his friends have said his relationship may have persuaded him to retire full-time across the border in the luxury complex.
When they arrived, they found that the condo was not yet ready, so they drove back across the border and checked into the Hercor Hotel in Chula Vista, San Diego.
The following morning, they headed back into Mexico, Merendino in his Range Rover with Meza following behind on his motorcycle - a 2014 Christmas gift from the victim, according to the affidavit.
They checked into Bobby's by the Sea hotel across the border, where Merendino was seen at the lobby between 7pm and 8pm on May 1, asking for a bottle opener.
At 10.30pm, guests claim they heard a motorbike leave the hotel. Only Meza had such a vehicle with him. He was caught on CCTV entering the US half an hour later.
Merendino then left the hotel at 1am, telling a security guard he had to leave to help a friend stranded on the road.
His body was found shortly after 3.30am that morning in a ravine only five minutes away from the accommodation.
No cameras showed Meza returning to Mexico. However, FBI files state that he was seen entering the US once more at 3.57am.
Roughly 25 minutes later, Miss Langston - driving a black SUV with no license plates - was seen at the same entry point before crossing back into the US.
At 7pm that night, the pair returned to Bobby's by the Sea in the black SUV Langston had been spotted in earlier.
According to hotel staff, Meza claimed he had to pick up personal items from the room he had been sharing with Merendino.
The rich Texan's $15,000 Rolex watch, iPhone, iPad and laptop were all later found to be missing.
Meza has previously denied killing Merendino.
However, documents show he has admitted that he and Langston were planning on robbing him, but ultimately pulled the plug on the plot.
The pair were arrested on Wednesday in Imperial Beach, California.
Meza faces federal counts of interstate or foreign domestic violence resulting in murder and conspiracy to obstruct justice.
Langston is accused of obstruction of justice, making a false statement to a federal officer and conspiracy to obstruct justice.
