Musso ( Hannah Montana), 20, Busted for DUI

Smoking salvia's not illegal, but drunk driving certainly is!

Mitchel Musso, known for his role as Oliver alongside Miley Cyrus on Hannah Montana, was busted for driving under the influence Sunday, TMZ reports. The 20-year-old was pulled over at 3:43 a.m. after failing to slow down for police who were directing traffic for an unrelated accident.

The site reports that police approached Musso's 2007 black Mercedes Benz and detected a "strong odor of alcohol." Law enforcement sources also told TMZ the PrankStars actor was given a field sobriety test and blew "well above .08," the legal limit in Calif. for those who are over the age of 21.

He was booked on suspicion of DUI and taken to a nearby police station.

It was almost a year ago that Musso's former costar Cyrus, 18, was videotaped smoking a bong and tripping on salvia, which is a legal herb.
