Prop 8 Backers Chide Judge Vaughn Walker In Gay Marriage Appeal

In urging an appeals court to overturn Chief U.S. District Judge Vaughn
 Walker's ruling that stuck down California's gay marriage ban, backers 
have called the ruling “egregiously selective and one-sided.”
After conducting a 13-day trial in January, Walker last month ruled 
Proposition 8 to be unconstitutional because it violates the right of gay 
men and lesbians to equal protection and due process. It is the first time
 a federal judge has ruled on the constitutionality of state-enacted gay
 marriage ban.
In written arguments submitted Friday to the the Ninth U.S. Circuit Court
 of Appeals, lawyers for ProtectMarriage.com, the sponsors of the ban, 
chided Walker for ignoring relevant information, including “judicial 
authority, the works of eminent scholars past and present in all
 relevant
 academic fields, extensive historical and documentary evidence,
” in finding
 the law unconstitutional and basing his opinion “almost exclusively 
on an uncritical acceptance the evidence submitted by Plaintiffs' 
experts.”
He “simply ignored virtually everything … that ran counter to its
 conclusions,” lawyers wrote in their 134-page brief.
The challenge was organized and funded by the American Foundation
 for Equal Rights (AFER), which is scheduled to submit its arguments
 next month. AFER is representing a gay couple and a lesbian couple
 who have been denied the right to marry because of Proposition 8.
Attorneys for ProtectMarriage.com urged the three-judge appeals court
 to ignore the testimony presented at trial, calling it “unreliable and
 ultimately irrelevant.”
Lawyers also rejected Walker's conclusion that Prop 8 supporters
 backed the measure out of animus towards gay men and lesbians, 
calling it an attack on the “many judges and lawmakers and millions 
of Americans who rightly and reasonably understand that marriage is 
the unique union of a man and a woman.”
In a statement released Friday, Chad Griffin, president of AFER, 
defended Walker's ruling, which he said was “based on our nation's
 most fundamental principles, and that the Constitution does not permit 
unequal treatment under the law.”
“Regardless of the defendant-intervenors' protests, the fact remains that Proposition 8 is unconstitutional, as was proven conclusively and 
unequivocally through a full federal trial,” Griffin said.
Oral arguments in the case are scheduled for the first week in December.

Adam Lambert Facing Possible Battery Charge

Pop singer Adam Lambert has been accused of attacking a photographer
According to a police report posted on the site, the 28-year-old Lambert allegedly became “angry and started running towards him in an aggressive manner” after the photographer began taking unwanted pictures.
“As the victim began to run away, the subject grabbed the victim's
 backpack where the camera was placed. The subject wrestled the 
victim to the ground forcefully. A crowd began to gather and the subject
 fled toward the boardwalk.”
The photographer did not sustain any “bruises or lacerations,” the report concludes.
Lambert, who came out gay last year on the cover of Rolling Stone,
 responded to the claim on Twitter, where he messaged his followers,
 “I lost my temper for a sec but wow it felt great lol MIAMI!!!”
In another tweet, he denied the charge: “Battery? Nope. I attempted to
 grab a camera, no punches were thrown and no one was on the ground
 … It was literally harmless. If embarrassment is a crime – that's all I'm
 guilty of.”
Police have yet to determine whether to prosecute Lambert.

Gay Marriage Coming To The Netherlands Antilles

Three former Dutch colonies are preparing to introduce gay marriage
 and adoption laws as they come under direct Dutch rule, Radio 
Netherlands reported.
The Netherlands Antilles, which consists of five small islands in the 
Caribbean Sea, are scheduled to be dissolved on October 10 and three 
of the islands are set to become special municipalities of the Netherlands.
The islands of Bonaire, Saba and Sint Eustatitus are expected to adopt
 Dutch law. The two largest islands, Curacao and Sint Maarten, are set to
 become independent states within the Kingdom of the Netherlands. The 
islands of Curacao and Bonaire are located off the Venezuelan coast, 
while Sint Eustatius, Saba and Sint Maarten are located southeast of the 
Virgin Islands. In 1986, the island of Aruba seceded to become an
 autonomous part of the Netherlands.
Last week, the lower house of the Dutch Parliament approved a bill to
 legalize gay marriage and adoption for gay and couples by 2012 in the 
three socially conservative islands coming under Dutch control. The
 Senate is expected to act on the bill soon.

Anti-Gay Freedom of Speech Suit Dismissed
Days after the passing of Prop 8 in California, a community college student named Jonathan Lopez gave a speech in class against same-sex marriage and half way through his homophobic spiel, the instructor cut him off and said that his speech was offensive to some students.  Lopez decided to sue the instructor…and won!
Now mind you, this wasn’t a matter of freedom of speech, this was a class assignment which is why I sounded off when a judge ruled in favor of Lopez.  But, the school appealed the decision and now justice has been served.
According to a post on Mercury News:
A federal appeals court has tossed out the lawsuit of a California community college student who claimed that a teacher illegally berated him in class for making a speech opposing same-sex marriage.
Remember folks, there’s a time and place for everything, and when you’re in school, the appropriateness of your class assignment is subject to the instructor’s discretion.

Coming Out Gay 'Unleashed' Ricky Martin's Creativity, Desmond Child Says

Desmond Child, who's producing singer Ricky Martin's upcoming studio
 album, says Martin's coming out gay has “unleashed” his creativity.
Martin came out gay on his official website in March after denying for
 years rumors about his sexuality.

In an interview with BlackBookMag.com, Child, who's also worked with
pop star Mika, says Martin's creativity has “exploded” since his announ-
cement.
In asking about “the next Ricky Martin record,” the legendary producer-songwriter responded: “I'm really excited about the music, the content,
 because since he's come out it's unleashed his creativity and the scope
of what he can sing about and say and do. … Once he opened that door,
 a floodgate of energy and creativity just really exploded.”
Child added that the yet-to-be-named album is “all over the place in
 a really great way.”
“We really reached a creative fusion of rock and pop and electronic and
 Latin music,” he said.
The thirty-eight-year-old Martin, father of twin boys Valentino and
Matteo, is expected to discuss more about being gay in his upcoming
memoir Me, set to hit bookstores on November 2.

Danny DeVito, Charlie Day Gay Marry On 'It's Always Sunny In Philadelphia'

The gang is back and ready to tackle gay marriage on Thursday's season
 premiere of FX's It's Always Sunny in Philadelphia.
The start of the show's sixth season began with a gay wedding between 
the characters played by Danny DeVito and Charlie Day.
In the episode, Mac (played by Rob McElhenney) is ditched by a
 transgender woman (Brittany Danke) to marry another man.
“My character decides that he is going to fight their union in court 
because he feels it's a gay marriage,” McElhenney told 
“I get married in season six, yup, yeah,” DeVito told the AP. “Don't ask
 me her name because it ain't a her.”
In fact, it's the character of Charlie, played by Day. The two men get
 a domestic partnership to qualify for health benefits.
“It's a very difficult road that they're going down,” McElhenney said.
“Dennis (Glenn Howerton) also gets married. And that is sort of the
 satirical look at marriage in this country and how difficult it was for
 Carmen, the transgender woman, to wind up getting married,” he added.

Oh what a ride it’s been, but hold on, it’s not over yet!  This week’s been nothing less than tumultuous when it comes to the debate over repealing the ban.
On one hand, we’ve got V.P. Joe Biden saying there are enough votes in the Senate to flat out repeal the law, but even if it was repealed, that repeal wouldn’t take effect right away.  Why?
According to what Biden had to say on Rachel Maddow’s show:
“Because that is the compromise we basically had to make to get the votes to finally repeal it. We had to build a consensus for this –working very hard on the telephone, calling people…and everybody’s looking for the orderly elimination of this law…. That’s why it hasn’t happened. It’s resulted in us getting over 55 votes –I think we’ll get 55 votes—to flat repeal it.”
But Biden’s optimism hasn’t prevented Senators Harry Reid and John McCain from going for each other’s jugulars over the issue.
As reported all over the place, Reid is getting targeted by McCain for trying to attach the repeal to the Defense Budget Bill. But McCain has also said he’d try to filibuster the bill because Reid is trying to attach immigration reform to the bill that would allow non-US citizens to be placed on a fast track for citizenship if they serve in the military, something McCain says Reid is doing to try to win votes in his upcoming re-election bid as he runs against the holy-rolling “I hate gays too” Sharon Angle.
But wait! There are some Republicans pushing for DADT’s repeal, of course they’re gay Republicans who are members of the Log Cabin Republicans who recently won a lawsuit that deemed DADT unconstitutional, as ruled by a U.S. judge…but because that judge is in California, members of the Pentagon have stated her powers are limited to that state. Crazy doesn’t seem to quite cover it.
So, will DADT be repealed? Will gay rights destroy the nation founded on white Christian supremacy liberty and justice for all?  Tune in next week as the answer unfolds.  This is better than any daytime soap!
